Amendment of the Law, Allowing Abortions Within 14 Weeks of Pregnancy

On October 7^th, the government unveiled its plan to amend legislation to allow abortion within 14 weeks of p regnancy without any criminal charges. Under the current Mother-Child Health Act, abortion is only permitted when pregnant women have genetic diseases and in case of rape or incest within 24 weeks of pregnancy. Any abortions that do not meet the above conditions are punished by fines or imprisonment. In April of last year, however, the Constitutional Court requested to the government to amend the current abortion law as it is severely violating women’s rights to self-determination. As a follow-up to the Constitutional Court’s judgment, the government came up with plans to make amendments to the law. First, abortions within 14 weeks of conception will be allowed without any reasons or procedures. Second, the government announced that more conditions will be added relating to social or economic reasons, allowing abortion for pregnancies of 15 weeks to 24 weeks. The government announced that this amendment plan will go through a rigorous review process by the Ministry of Government Legislation and the State Council. After being submitted by the national assembly, the amendments will be made before the end of this year.
